Terms and Conditions

Welcome to Mascori. These Terms and Conditions (“Terms”) govern your access to and use of the Mascori website, marketplace, Business Directory, Academy, Magazine, artificial intelligence features, prompts, creative resources, membership services, and related products and services collectively referred to as the “Platform.”
The Platform is operated by MASCORI, referred to in these Terms as “Mascori,” “we,” “us,” or “our.”
By accessing the Platform, creating an account, purchasing a product or membership, publishing content, or using any Mascori service, you agree to these Terms and our Privacy Policy, Disclaimer, and any additional policies applicable to a particular service.
If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, purchase a membership, sell products, publish a business listing, or use paid services.
If you use Mascori on behalf of a company or organization, you represent that you have authority to accept these Terms on its behalf.
2. Accounts
Certain features require an account. You agree to provide accurate, current, and complete information and to update it when necessary.
You are responsible for:

Protecting your login credentials.

All activity conducted through your account.

Preventing unauthorized access.

Notifying Mascori promptly if you suspect unauthorized use or a security breach.
You may not transfer, sell, share, or impersonate another person’s account without authorization.
Mascori may reject, suspend, restrict, or close accounts that violate these Terms, present a security risk, remain unpaid, or are used fraudulently or unlawfully.
3. Acceptable Use
You agree not to use Mascori to:

Violate any law, regulation, license, contractual obligation, or third-party right.

Upload or distribute malware, malicious code, spam, scams, or deceptive content.

Harass, threaten, exploit, discriminate against, or harm another person.

Publish unlawful, defamatory, fraudulent, obscene, or intentionally misleading material.

Infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights.

Scrape, harvest, copy, or systematically extract Platform content or user information without written permission.

Circumvent security measures, access restrictions, payment controls, or usage limits.
-
Interfere with the operation, performance, or security of the Platform.

Use automated systems in a manner that places an unreasonable burden on Mascori.

Misrepresent your identity, qualifications, products, services, affiliations, or business information.

Use Mascori to create or distribute content that is unlawful or violates the rules of another platform.
We may investigate suspected violations and remove content or restrict access when reasonably necessary.
4. Platform Content
Unless otherwise stated, the Platform and its original design, branding, text, graphics, software, arrangement, and functionality are owned by or licensed to Mascori and are protected by applicable intellectual property laws.
Mascori grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Platform for its intended personal or business purposes.
This license does not permit you to reproduce, resell, republish, reverse engineer, create competing databases from, or commercially exploit Mascori’s proprietary content without written permission.
5. User Content
“User Content” includes business listings, product information, images, designs, reviews, comments, advertisements, descriptions, files, prompts, and other materials submitted through the Platform.
You retain ownership of the rights you hold in your User Content. By submitting it, you grant Mascori a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, distribute, and use it as reasonably necessary to operate, promote, secure, and improve the Platform.
You represent that:

You own your User Content or have all necessary permissions to use it.

Your content is accurate and not intentionally misleading.

Its publication does not violate any law or third-party right.

You have obtained necessary permissions from identifiable people appearing in your content.
You remain responsible for your User Content. Mascori may remove or restrict content that violates these Terms or creates legal, safety, reputational, or operational concerns.
6. Artificial Intelligence Features
Mascori may provide AI-assisted tools, image generation, prompts, recommendations, descriptions, or other automated features.
AI outputs may be incomplete, inaccurate, similar to content produced for others, or unsuitable for a particular purpose. You must review all output before relying on, publishing, selling, or distributing it.
You are responsible for:

The instructions and materials you submit.

Determining whether you have permission to upload reference materials.

Reviewing outputs for accuracy and suitability.
-
Confirming compliance with copyright, trademark, privacy, publicity, and other applicable rights.

Following the rules of any marketplace or service where the output is used.
Unless expressly stated otherwise, Mascori does not guarantee ownership, exclusivity, copyright protection, originality, non-infringement, or commercial eligibility of AI-generated output.
You may not use AI features to impersonate others deceptively, violate intellectual property rights, create unlawful material, or engage in fraud or abuse.
7. Prompts, Templates, and Digital Resources
Prompts, templates, graphics, guides, downloads, and other digital resources are licensed, not sold, unless expressly stated otherwise.
Your specific license and permitted uses may be described on the applicable product page. Unless a broader license is expressly provided, purchases are for use by the purchaser and may not be resold, redistributed, sublicensed, shared, or offered as a competing standalone product.
Purchasing or accessing a creative resource does not guarantee a particular output, marketplace approval, audience response, income, or commercial result.
Because digital products may be delivered immediately, purchases may be nonrefundable where permitted by law. Any applicable refund terms will be presented before purchase or included in Mascori’s Refund Policy.
8. Business Directory
Businesses and professionals may create or claim directory listings subject to the available plan and verification requirements.
Listing owners must provide accurate, current, and lawful information. They may not falsely claim a business, fabricate credentials or reviews, manipulate ratings, or misrepresent their services.
Directory inclusion does not constitute certification, endorsement, employment, partnership, or a guarantee by Mascori.
Users are responsible for evaluating listed businesses and verifying licenses, insurance, qualifications, prices, availability, and policies before entering into a transaction.
Agreements, communications, payments, services, and disputes between directory users and listed businesses are solely between those parties unless Mascori expressly states otherwise.
Mascori may modify, suspend, reject, or remove listings that are inaccurate, duplicated, abandoned, misleading, unlawful, or inconsistent with Platform standards.
9. Marketplace Purchases
Product descriptions, prices, availability, shipping estimates, and photographs are subject to change. Reasonable differences may exist between digital previews and physical products, including differences in color, size, print placement, and appearance.
Orders are not accepted until payment is authorized and an order confirmation is issued. We may cancel or limit an order because of suspected fraud, pricing errors, inventory issues, production limitations, legal restrictions, or inaccurate product information.
Some products may be produced or fulfilled by print-on-demand providers, independent vendors, shipping carriers, or other service partners.
Purchases are also subject to the applicable Shipping, Return, Refund, and Cancellation Policies displayed on the Platform.
10. Vendors and Sellers
When vendor participation is available, sellers are responsible for:

Maintaining accurate product and business information.

Possessing the rights required to sell their products and designs.

Product safety, quality, legality, and regulatory compliance.

Order fulfillment and customer service responsibilities assigned to them.

Applicable licenses, permits, taxes, and reporting obligations.

Their own warranties, representations, return obligations, and business practices.

Following Mascori’s seller policies and applicable third-party provider requirements.
Mascori may review, reject, remove, or suspend products and vendors when reasonably necessary. Platform access does not guarantee exposure, traffic, sales, or revenue.
Unless expressly identified as the seller, Mascori is not the manufacturer or owner of products offered by independent vendors.
11. Prices, Payments, and Taxes
Prices are displayed in the currency identified at checkout. Applicable taxes, shipping charges, transaction fees, or other charges may be added before payment is completed.
Payments may be processed by third-party payment providers. Your use of those services is subject to their terms and privacy policies.
You agree to provide valid payment information and authorize the charges shown at checkout. You are responsible for taxes, duties, or fees applicable to your purchase or business activity unless applicable law assigns that responsibility to Mascori.
Mascori may correct pricing or billing errors. If a correction materially affects an order already placed, we will provide notice and any options required by law.
12. Memberships and Automatic Renewal
Some features may require a paid membership or subscription. The price, billing frequency, included services, renewal terms, and available cancellation method will be disclosed before enrollment.
If you choose an automatically renewing membership, you authorize recurring charges using your selected payment method until you cancel.
You may cancel through the method described during enrollment or in your account. Unless otherwise stated or required by law, cancellation prevents future renewal charges but does not retroactively refund charges already incurred.
Mascori may change membership prices or features after providing any notice required by law. Continuing a membership after the effective date constitutes acceptance of the change.
If payment cannot be completed, we may suspend or terminate access to paid features.
13. Promotions and Discount Codes
Promotions, credits, coupons, and discount codes may be subject to additional conditions and expiration dates. They have no cash value, may not be combined unless stated otherwise, and may be modified or withdrawn where permitted by law.
Fraudulent or abusive use may result in cancellation of the promotion, order, or account.
14. Reviews and Testimonials
Reviews must reflect genuine experiences and must not contain unlawful, fabricated, abusive, or misleading claims.
Users must disclose any material relationship, compensation, free product, discount, or other incentive connected to a review or endorsement.
Testimonials and examples displayed on Mascori do not guarantee that other users will achieve the same results.
15. Third-Party Services and Links
Mascori may integrate with or link to third-party websites, payment processors, fulfillment services, marketplaces, shipping providers, and software platforms.
Third-party services are controlled by their respective operators and may be subject to separate terms, fees, restrictions, and privacy practices. Mascori is not responsible for third-party content, availability, security, conduct, or performance.
The inclusion of a link or integration does not necessarily constitute endorsement or partnership.
16. Copyright and Intellectual Property Complaints
Mascori respects intellectual property rights. If you believe content on the Platform infringes your copyright or trademark, send a written notice containing:

Identification of the protected work or right.

Identification and location of the allegedly infringing material.

Your name and contact information.
-
A statement explaining your good-faith belief that the use is unauthorized.

A statement that the information in your notice is accurate.

Your physical or electronic signature.

Mascori may remove disputed material and terminate repeat infringers where appropriate. If Mascori intends to rely on the protections of the Digital Millennium Copyright Act, its designated agent should also be registered with the United States Copyright Office.
17. Suspension and Termination
You may stop using Mascori at any time. Account and membership cancellation remain subject to any applicable billing, refund, or order obligations.
Mascori may suspend, restrict, or terminate access if you:

Violate these Terms or another applicable policy.

Fail to make required payments.

Create legal, security, fraud, or safety risks.

Abuse Platform features or other users.
-
Engage in conduct that may harm Mascori or its community.
Provisions that by their nature should continue after termination—including ownership, payment obligations, disclaimers, limitations of liability, and dispute terms—will survive.
18. Disclaimer of Warranties
To the fullest extent permitted by law, the Platform is provided on an “as is” and “as available” basis.
Mascori does not guarantee that the Platform will be uninterrupted, secure, error-free, or suitable for every purpose, or that all information and results will be complete or accurate.
Nothing in these Terms excludes warranties, consumer protections, or other rights that cannot legally be waived.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Mascori and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Platform.
Mascori is not responsible for losses caused by user content, independent vendors, directory businesses, third-party services, unauthorized account access, reliance on AI output, or business decisions made using Platform information.
To the fullest extent permitted by law, Mascori’s total liability for a claim will not exceed the greater of:
- The amount you paid Mascori for the specific product or service giving rise to the claim during the preceding 12 months; or
- One hundred U.S. dollars ($100).
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
20. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mascori and its owners, employees, contractors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

Your violation of these Terms.

Your unlawful or improper use of the Platform.

Your User Content, products, listings, or business activities.
-
Your infringement of another person’s rights.
-
A dispute between you and another user, customer, vendor, or listed business.
This section does not require you to indemnify Mascori for conduct for which indemnification cannot legally be required.
21. Changes and Availability
Mascori may add, modify, suspend, or discontinue Platform features, content, plans, or services. We do not guarantee that any feature will remain available permanently.
We may revise these Terms periodically. Material changes will become effective after the notice or consent required by law. The effective date will be shown at the top of this page.
Your continued use after revised Terms become effective constitutes acceptance of those Terms.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Before filing a formal claim, you and Mascori agree to make a reasonable good-faith effort to resolve the dispute informally by providing written notice and allowing at least 30 days for a response.
Unless applicable consumer law requires otherwise, legal proceedings relating to these Terms or the Platform must be brought in the state or federal courts located in Santa Barbara, California, and each party consents to jurisdiction in those courts.
Nothing in these Terms prevents either party from seeking appropriate relief in small claims court or requesting urgent relief to protect intellectual property, confidential information, or Platform security.
23. Additional Terms
Certain products, services, memberships, promotions, or Platform sections may include additional terms. If additional terms conflict with these general Terms, the terms specifically applicable to that product or service will control.
If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision does not waive the right to enforce it later.
These Terms, together with incorporated policies, constitute the entire agreement regarding your use of the Platform.
